TERMS AND CONDITIONS
Wink Photography (UK) Ltd: Trading as Wink Photography here as referred to as Wink and or Wink Photography, of 30 Henley Street, Stratford Upon Avon CV37 6QW, The Custard Factory, Gibb Street, Birmingham B9 4AA and 32 Church Gate, Leicester LE1 4AJ.
Company Registration Name and Number: Wink Photography (UK) Ltd 6291365.
Client: For the purpose of these Terms and Conditions, the term Client is anybody buying, hiring and renting services from Wink Photography (UK) Ltd.
Images: Photographs, digital/prints, post and final production produced by Wink Photography.
Equipment: Any item, space or product belonging to or rented by Wink Photography.
1.1 Prices are quoted in pounds sterling and are inclusive of VAT (charged at the standard UK rate).
1.2 Wink Photography may increase all prices quoted and used on promotional material without prior notice. Notice will be provided to confirmed Client bookings, or if any alteration to the specification or the services is made at the request of the Client to the extent that such alteration would have given rise to an increase in the quoted contract price had it been allowed for.
2. Delivery & Payment Policy:
2.1 Sessions with Wink Photography:
Clients pay in full for the sitting fee when booking a service, either directly with the relevant studio or by purchasing external vouchers redeemable at Wink Photography. Wink Photography Gift Vouchers are also accepted. A re-fundable deposit is taken at the point of booking, which will either be fully refunded after the viewing appointment, or the value discounted from any purchases, subject to clause 3.1 below. This refundable deposit is charged for all External Voucher and Gift Voucher bookings, where no direct payment has been made to the relevant studio.
2.2 The photographs are selected and paid for by the Client on an agreed viewing day (by appointment only), normally within 7-21 days after the session.
2.3 Sales are treated on an individual basis and the Client will be notified at the point of sale as to an estimated delivery time following their viewing. If the Client orders a product that is produced outside of the studio then the average timeframe for receiving the product is approximately 14-28 days.
2.4 The method of delivery will be either by post (prints and discs only, at additional cost), or by collection from the studio, once Wink Photography has notified the client it is ready for collection.
2.5 Wink Photography accepts payments by credit/debit card, cheque cash and 0% finance arrangements (subject to approval). Goods are not released until full payment is received.
2.6 Wink Photography will store and make ready for collection all products for one year after purchase. Products not collected within one year of purchase will be distroyed without notice.
3. Cancellation & Refund Terms:
3.1 Wink Photography reserves the right to cancel a booking (without refund) if the Client is not punctual and or they have not adhered to health and safety instructions and or if they are at fault for damaging equipment/furniture/fixtures and fittings within the studio. Wink Photography protects the safety and welfare of it's staff and any agression towards staff will result in immediate cancellation of an appointment. The Client may be liable to Wink Photography for the full cost of the session plus damages and loss of earnings.
3.2 Photo and Viewing Sessions:
Clients are permitted to cancel/change a photography session/viewing appointment up until 48 hours prior to the allotted date. Cancelling within 48hrs notice will incur a cancellation fee of £20.00.
3.3 Wink Photography works on a no obligation promise that if you do not like the photographs, then you are under no obligation to make any purchases, other than the initial session fee. Wink Photography copyright however will remain on the photographs from the session (see Prints, Copyright and Display for further details).
3.4 Once goods are purchased (including digital files) refunds cannot be offered. If however goods are found to be faulty in any way, please contact the studio within 48 hours and a replacement will be arranged free of charge. You will be asked to return the faulty goods once the replacement is in.
4.1 Vouchers are valid until the date shown on the voucher.
4.2 All vouchers are only applicable to the offer shown, and cannot be used in conjunction with any other offer or voucher from any source.
4.3 Vouchers are not transferable or usable after the date as shown. Studios may at their discretion allow shoots to take place after the expiry date, as long as the appointment is made prior to the expiry date.
4.4 Dates and times available for your photography session are booked on a first come first served basis. At the time of booking your session, you will be asked to pay the required booking fee and refundable deposit, which must be paid by debit/credit card, cash or cheque.
4.5 The voucher may not be used in conjunction with any other discount or offer; it is not redeemable for cash or goods and may only be used as described, and only one voucher per photo session/per household applies.
4.6 The voucher may not be used to purchase photographs from a previous studio session.
4.7 All other General Terms and Conditions apply.
5. Prints, Copyright and Display:
5.1 Owing to Wink Photography techniques it may not be possible to match exactly all colours as seen at the viewing.
5.2 The photographs, digital files, prints, edits and post production produced by Wink Photography are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without Wink 's explicit written permission. Images supplied on any of Wink’s purchased CD's offers are excluded from this clause, although Wink requests that any images published are acknowledged as to have been taken by Wink Photography.
6.1 Wink Photography is committed to preserving your privacy. Any information that we hold is, subject to these terms, processed and kept securely in accordance with the Data Protection Act 1998. We employ security measures to protect any information that we hold about you from access by unauthorised persons, unlawful processing, accidental loss, destruction and/or damage. We only keep the information for a reasonable period or as long as the law requires and we do not store any financial details about you.
6.2 Your data may be used by Wink to advise you of products, services and special promotions – Wink will not pass on your details to third parties. We may contact you by post, telephone, SMS text or email.
6.3 We take reasonable steps to ensure that the information that we hold is accurate and up to date. Wink's Website may contain links to Third Party Sites, which are outside our control and are not covered by these Terms.
7. Protection Policy:
7.1 Wink Photography aims to recruit people into position of trust and adhere to protecting children and vulnerable adults policies. Wink staff are instructed not be alone with children at any time and at least one member of the Client’s party must be above the age of 18 for all appointments.
8. Health & Safety Policy:
8.1 Wink Photography takes every reasonable effort to ensure the premises and equipment is deemed as suitable and safe for all users at all times.
8.2 The Client is fully responsible for their own action and responsible for the children they are in the accompany of, and any damages or breakages to the property that incur as a result of the Clients action shall be the responsibility of the Client to pay or rectify as agreed with Wink Photography.
8.3 Wink Photography does not take any responsibility for any loss or damage to any personal belongings within or outside the studio. Wink’s photography sessions can involve some physical activity, which is undertaken at your own risk.
8.4 Wink Photography expects Clients to advise of any special or medical requirements are needed to make the Clients experience at the Studio more comfortable and accessible.
9. Customer Service Contact Information:
9.1 The Client is required to adhere to Wink Photography policies where applicable. If the Client is unhappy with a product or service, then the Client should contact Wink Photography with the complaint as soon as possible. Wink will manage the complaint on an individual basis that will not affect the Client's statutory rights. Wink will not be liable for any claims for consequential loses howsoever caused.
